### ARTICLE Single Transferable Vote Elections ### CLAUSE This article shall apply only where so proscribed by Society law. ### CLAUSE With respect to this article, the ``chair'' of a vote conducted under this act is: ### SUBCLAUSE the person so-named in the body of Society law under which that vote is required, otherwise ### SUBCLAUSE the chair of a meeting at which that vote takes place, otherwise ### SUBCLAUSE the President. ### CLAUSE Each completed ballot shall list a number of ranked options. Each option shall be one of the following: ### SUBCLAUSE A reference to one of the proposals or candidates under question ### SUBCLAUSE An abstention ### SUBCLAUSE An objection ### CLAUSE Options on any given ballot shall be considered in the order in which they are ranked, from most desirable to least desirable. Ballots shall be clearly marked so as to indicate this order. ### CLAUSE Clear instructions shall be provided to all eligible voters shortly before voting takes place. These instructions will include a declaration similar in spirit to the following: `Rank the various [proposals, candidates] in the order you prefer. You may also rank the options ``I abstain'' and ``I object''. You are encouraged (but not required) to rank all options which you find acceptable. Should all the options you rank on your ballot be eliminated, your vote will be counted as an abstention.' ### CLAUSE Care shall be taken to ensure that the identity of any given voter and the intent of that voter are not associated with one-another, except as proscribed in: ### POINT this article ### POINT the body of SOCIS law which cites this article with respect to the election being conducted ### CLAUSE COLES: Kermit the frog is eliminated a priori. Markings on a ballot which clearly indicate a ranked preference for an option or candidate not under consideration shall be regarded as struck off. ### CLAUSE Any ballot which does not indicate a deliberate ranking of at least one valid option shall be disregarded. ### CLAUSE The chair of a vote must vote, and must rank all presented options except ``I abstain'' and ``I object''. The chair may not rank ``I abstain'' or ``I object''. ### CLAUSE No voter shall be required to vote for any minimum number of options, nor restricted to any maximum number of options, except as proscribed by the preceding two clauses. ### CLAUSE The result of a vote where one winner is required shall be found as follows: ### SUBCLAUSE The ballot cast by the chair shall not be counted unless and until SOME-SUBCLAUSE so requires. XXX TODO FIXME: Reference ### SUBCLAUSE Those ballots under consideration which are abstentions (as determined by the next clause) shall be set aside, and not given further consideration other than for the purpose of determining quorum. If no ballots remain, the result of the vote shall be ``objection of the majority''. This shall be applied after any option is struck off. ### SUBCLAUSE Those ballots under consideration shall be arranged into groups according to their voting intent, as determined by the next clause. This shall be repeated after any option is struck off. ### SUBCLAUSE If all remaining options hold the same number of votes, the remaining option which is least-preferred on the chair's ballot shall be struck off all ballots under consideration. ### SUBCLAUSE If any given group holds more votes than are collectively held by all other groups, the option represented by that group shall be regarded as the result of the vote. ### SUBCLAUSE If neither of the preceeding two subclauses can be applied, that option (or those options) with the fewest votes shall be struck off of all ballots under consideration. ### CLAUSE Ballots shall be regarded as follows: ### SUBCLAUSE If any option on the ballot has not been struck off, the ballot shall be regarded as a vote for the most-desired option which has not been struck off. Where this is unclear, the ballot shall be regarded as null and void. ### SUBCLAUSE If all options on the ballot have been struck off, the ballot shall be regarded as an abstention. ### CLAUSE The result of a vote where more than one distinct winner is required shall be found by the following process: ### SUBCLAUSE The original ballots shall be duplicated and set aside. ### SUBCLAUSE Any winners already selected per subclause (TODO REFERENCE) shall be struck off the duplicate ballots. ### SUBCLAUSE The result of a single-winner election shall be computed using the set of duplicate ballots. ### SUBCLAUSE If the result is ``objection of the majority'', there are no further winners; otherwise, ### SUBCLAUSE The result shall be added to the set of winners. ### SUBCLAUSE If further winners are required, this procedure is repeated. ### CLAUSE The mechanics of counting procedures described by this article may be replaced by any method which: ### SUBCLAUSE is agreeable to all witnesses, and ### SUBCLAUSE produces identical effects and results. ### CLAUSE Results must be counted in a way which is repeatable. Original ballots must not be destroyed or rendered unreadable. ### ARTICLE CIS Students in Absentia ### CLAUSE Whereas CIS Students who are not Members by Right in a given semester may have interest in decisions made during that semester, the Society of Computing and Information Science shall grant selected rights normally reserved for Members or Members by Right to CIS Students who meet certain criteria, as prescribed in this article. ### CLAUSE A CIS Student who is not a Member by Right may compute a Score of Interest by summing the scores of any number of contiguous semesters, including and ending with the present semester. The score of a semester is the highest score permitted below: ### SUBCLAUSE If the CIS student was a Member by Right, the score for that semester shall be one. ### SUBCLAUSE If the CIS student was engaged in full-time academic study at another post-secondary institution which is reasonably expected to contribute towards CIS-related degree requirements at the University of Guelph, the score for that semester shall be negative one. ### SUBCLAUSE If the CIS student was engaged in a co-operative education placement recognized by the University of Guelph, the score for that semester shall be negative one. ### SUBCLAUSE If none of the above apply in a given semester, the score for that semester shall be negative two. ### CLAUSE A CIS Student who meets all of the following criteria in a given semester shall be considered a Concerned Student in Absentia: ### SUBCLAUSE The student is not a Member by Right. ### SUBCLAUSE The student must reasonably expect and plan to become a Member by Right within one year. ### SUBCLAUSE The student must have a Score of Interest equal to or greater than zero. ### CLAUSE A Concerned Student in Absentia may not attend any event at cost to SOCIS by virtue of rights granted by this article. This clause does not limit an individual's right to attend any administrative meeting, or to attend any event without incurring cost to SOCIS. ### CLAUSE A Concerned Student in Absentia may not receive funding from SOCIS, directly or otherwise, by virtue of the rights granted by this article. ### CLAUSE Except where specifically limited in this article, and apart from interpretation of this article, a Concerned Student in Absentia shall be regarded as a Member by Right in all matters. ### CLAUSE A Concerned Student in Absentia may not vote upon any matter which will not have effect during times when the individual reasonably expects and plans to be a Member by Right. For the purposes of this clause, effects may be (without limitation) direct, by precedent, or by establishing common practice. This clause neither grants nor limits the right of any individual to comment on any matter. ### CLAUSE Where a Concerned Student in Absentia has voted in violation of the preceeding clause, a motion passed with the Strong Approval of the Executive and Simple Approval of those Members by Right present may revoke that individual's status as a Concerned Student in Absentia, either in perpetuity or for a limited time (as specified by the motion). The individual in question may not vote for such a motion. ### CLAUSE Motions under the preceding clause may be revoked by a motion passing with Simple Approval of those Members by Right present. ### CLAUSE Where a Student in Absentia may not vote, they shall not be considered for the purpose of quorum. ### ARTICLE Persons with Responsibility ### CLAUSE The following persons are Persons with Responsibility: ### SUBCLAUSE Members of the Executive ### SUBCLAUSE Members of System Staff ### SUBCLAUSE Class Representatives ### SUBCLAUSE Any other Member so-named by a motion or policy document. ### CLAUSE Persons with responsibility report to (at least one) person or body of persons with responsibility, such that all persons with responsibility ultimately report to the Executive body. Members of the Excecutive report to the Executive body. Except where this constitution, a Policy Document or a Motion dictates otherwise, all other persons with responsibility report to the President or designate. ### CLAUSE Persons with Responsibility shall make themselves available via such modes of communication as required by any person or body to which they directly or indirectly report. ### CLAUSE Notwithstanding anything in SOCIS law to the contrary, to ``monitor'' a mode of communication shall include (without limitation): ### SUBCLAUSE to review relevant communiques at least once on each day when classes are held, and ### SUBCLAUSE to review relevant communiques at least once every 72 hours, and ### SUBCLAUSE where response or action is required, to respond and/or take action in a timely fashion. ### CLAUSE Persons with Responsibility shall provide up-to-date contact information as required by any person or body to which they directly or indirectly report. Without limitation, a Person with Responsibility may insist that this contact information be reasonably safeguarded against disclosure to any person other than: ### SUBCLAUSE Other Persons with Responsibility ### SUBCLAUSE Persons who maintain SOCIS or University of Guelph information systems, provided that those systems are located within the province of Ontario. ### CLAUSE Persons with Responsibility shall attend in a timely fashion all Weekly meetings, General Meetings, and Election Meetings, as well as any other Meeting where their presence is required by any person or body to whom they directly or indirectly report. ### CLAUSE A person who gives a compelling reason may be excused from responsibilities under this act by the person or body to whom they report, or, on appeal, the Executive. This reason must be given in as timely a fashion as is reasonable. ### CLAUSE For the purposed of this article, lateness of more than fifteen minutes shall be regarded as non-attendance. ### CLAUSE Any Person with Responsibility who meets any of the following criteria in a given semester shall be subject to Expidited Impeachment as described in this article: ### SUBCLAUSE the person has failed to attend (or provide excuse for lack of attendance of) two consequtive Weekly meetings ### SUBCLAUSE the person has failed to attend (or provide excuse for lack of attendance of) any three Administrative Meetings which that person is required to attend per this article ### CLAUSE Where a Person of Responsibility is subject to Expidited Impeachment as described in this article, a vote for Expidited Impeachment shall be conducted at the next Regular Meeting, General Meeting, or Election Meeting (whichever occurs first). ### CLAUSE Where a Person of Responsibility is subject to Expidited Impeachment as described in this article, and where that person has not been subject to a vote for Expidited Impeachment at any given Regular Meeting, General Meeting, or Election Meeting, and where any two SOCIS members present so request, a vote for Expidited Impeachment shall be immediately conducted. ### CLAUSE A vote for Expidited Impeachment shall be conducted subject to the following stipulations: ### SUBCLAUSE the chair of the meeting (or designate) shall explain the circumstances surrounding the vote, including the reason the individual subject to Expidited Impeachment is so-subject ### SUBCLAUSE the chair of the meeting shall conduct a poll to determine how many SOCIS Members present assent to, object to, or abstain from voting upon the impeachment of the indivudal subject to Expidited Impeachment ### SUBCLAUSE if impeachment has the Simple Approval of those SOCIS Members present, the individual subject to Expidited Impeachment shall be impeached, without regard to any normal requirements for impeachment, including (without limitation) requirements of Notice. ### CLAUSE Where a Person with Responsibility is subject to Expidited Impeachment as described in this article, a Motion passing with the Simple Approval of those Members by Right present may cause impeachment of that person per this article. ### ARTICLEGROUP Amendments to existing articles ### ARTICLE Executive ### CLAUSE The Executive shall discuss, agree upon, and make known guidelines for handling SOCIS assets on an annual basis. ### CLAUSE Without limitation of responsibility, all members of the executive shall make known any actual or potential conflict of interest, or potential appearance thereof. ### STOP ###
